Forest area status: the check that can sink a land deal
Why land with a certificate or a permit can still sit inside Indonesia's forest estate, how to check it and what release, PPKH and the 2025 task force mean.

In Indonesia a forest area (kawasan hutan) is a legal status. It says nothing about what actually grows on the land. A plot can be bare or planted with oil palm and carry a land certificate or a plantation licence, yet still sit inside the forest estate. If it does, neither the certificate nor the licence lets you plant or mine there.
Since 2025 a government task force has been taking back plantations found inside forest areas. Under rules in force since 19 September 2025, an operator without a forestry permit can pay the fine and still lose the land to a state-owned company. Check forest status at the very start of a deal.
What a forest area is
Government Regulation 23 of 2021 on forestry defines a forest area as land the government has set aside to remain permanent forest. Since October 2024 it’s the business of the Ministry of Forestry, split from the former Ministry of Environment and Forestry. Environmental approvals went to a separate Ministry of Environment.
There are three functions. Conservation forest covers nature reserves and national parks. Protection forest is there to regulate water and prevent floods and erosion. Production forest is for timber and other forest products, and it includes convertible production forest (Hutan Produksi yang dapat Dikonversi, HPK), the part that can be set aside for development outside forestry. Land outside the forest estate is other-use area (areal penggunaan lain, APL), where ordinary titles and plantation licences belong.
A land title or a business licence doesn’t take land out of the forest estate. Only a decision of the forestry minister does.
How land becomes forest area
Gazettement (pengukuhan) runs in four stages: designation on a map (penunjukan), marking the boundary on the ground (penataan batas), mapping and establishment by the minister (penetapan). A boundary committee is supposed to settle land rights along the boundary line, and the establishment decision records any that remain.
Many areas were designated on maps before their boundaries were marked, so people farmed, settled and got titles on land the map put inside the forest estate. Under Government Regulation 23 of 2021, land held or titled before designation can be taken out by changing the boundary, and land taken up later is settled case by case. These routes are for people and public or social bodies, not companies. An individual’s plot qualifies only up to 5 hectares, taken up before the Job Creation Law and held in good faith for at least five years. Customary claims are covered in customary land and community consent.
How to check it
Get the coordinates of every plot or block from the certificate’s survey data, the licence maps or your own surveyor. Overlay them on the current forest area map for the province, with every later change, and ask the forestry ministry’s regional office for forest-area gazettement to confirm the result in writing.
Check the whole asset, not a sample. An estate can be mostly clean with a few blocks inside, and those blocks carry the risk. For a mine, compare the map in the forest-use approval with the ground actually opened and planned. Ask whether the company appears in the minister’s decisions listing businesses inside forest areas without permits, or has had a task force notice.
Planting or mining inside a forest area
To plant inside a forest area, the land first has to be released (pelepasan kawasan hutan) from the forest estate. Only released land can then be granted as a right to cultivate (HGU). For a new plantation, release is possible only in convertible production forest, and as a rule only where that forest is no longer productive, after a study by an integrated team the minister forms. The steps that follow are in plantation permits and HGU.
A mine needs a forest-use approval (persetujuan penggunaan kawasan hutan, PPKH), which leaves the land’s status unchanged. It’s granted only in production forest, where open-pit or underground mining is allowed, and in protection forest, where only underground mining is. The approval runs as long as the mining licence. Its holder must mark the boundary within one year, pay a non-tax state charge for the use, plant trees to rehabilitate watersheds and reclaim the ground it has finished with. A mining licence without a PPKH for the ground being worked doesn’t make the mining legal, as mining licences explains.
Articles 110A and 110B, and the task force
The Job Creation Law (Law 11 of 2020, re-enacted as Law 6 of 2023) added two articles to the law on preventing forest destruction (Law 18 of 2013) for businesses already inside forest areas.
Article 110A covered businesses with a licence issued before the law, such as a location permit or a plantation licence, but no forestry permit. They had until 2 November 2023 to complete the forestry requirements and pay the forest fees owed, in return for release or an approval to keep operating. Under Government Regulation 24 of 2021, as amended by Government Regulation 45 of 2025 from 19 September 2025, a business that missed the deadline owes a fine of 10 times the forest resource fee and reforestation fund due, and loses its licence if it doesn’t pay.
Article 110B covers mines, plantations and other businesses built inside forest areas before the law without a forestry permit, where 110A doesn’t apply. They face a halt to the business, a fine and government coercion, and the 2025 amendment added reclaiming the land. Once the fine is paid, the task force takes the area back, and its management goes to a state-owned company named by the minister for state-owned enterprises.
The task force is the Forest Area Control Task Force (Satgas PKH), set up under Presidential Regulation 5 of 2025. On 13 May 2026 it reported that it had taken back close to 5.9 million hectares of forest area from oil palm estates since February 2025, and reclaimed land was being passed to the state-owned PT Agrinas Palma Nusantara. Buying an existing plantation covers what this means for a purchase.
Before you buy
- Compare what the title or licence covers, what’s planted or dug and what the forest map shows.
- For any part inside a forest area, ask for the release decision, the PPKH or the 110A settlement papers, with proof that fees and fines were paid.
- Treat any block without those papers as land you can lose, and price it that way.
- Make clean forest status a condition of the deal, with the right to walk away.
